Triptix – TERMS AND CONDITIONS

  1. Introduction

1.1. Welcome to Triptix!  We are thrilled to have you here. Before you start using our services, you must read and agree to these Terms of Service (“Terms”) and our Privacy Policy. Together, they govern your relationship with Triptix, impacting your rights and outlining your and our responsibilities when you use our services.

1.2. When we say “you” or “your”, we mean both you and any person or entity on whose behalf you’re acting, if applicable. When we say “we”, “us”, “our” or “Triptix”, we’re referring to Triptix and its agents.

1.3. The “Website” refers to our website, located at triptix.co, and the “Services” refer to the products and services provided by Triptix.

1.4. By using our Services, you’re agreeing to these Terms and confirming that you have read our Privacy Policy. If you don’t agree with these Terms or our Privacy Policy, you must not use our Services.

1.5. We may update these Terms and our Privacy Policy from time to time. If we believe the modifications are material, we’ll definitely let you know by doing one (or more) of the following: (1) posting the changes on our Site and Apps and/or (2) sending you an email or message about the changes. Changes become effective thirty (30) days after we post them. If you continue to use our Services after changes become effective, you  will be deemed to have agreed to all of the changes.

1.6. Please note that these Terms also incorporate the Triptix Refund Policy, which forms an integral part of your agreement with us.

  1. Definitions

2.1. “Website” refers to Triptix’s primary website accessible at triptix.co, including all subdomains, programming code, related technologies, communications, and Content.

2.2. “Services” means any products, services, content, features, technologies, or functions, and all related websites, applications, and services offered to you by Triptix.

2.3. “Content” includes, but is not limited to, text, graphics, images, music, software, audio, video, works of authorship of any kind, and information or other materials that are posted, generated, provided, or otherwise made available through our Services.

2.4. “User Content” means any Content that account holders (including you) provide to be made available through the Services. Content includes, without limitation, any feedback, comments, or suggestions you may provide regarding the Services or any other content or material you provide through the Services or submit to us for any purpose.

2.5. “Affiliate” refers to any company, corporation, entity, or individual that pays us a commission for promoting their services.

2.6. “Member” or “Membership” refers to the individual or entity that has registered for an account with Triptix to use the Services provided.

2.7. “App” refers to Triptix’s mobile application, including all related programming, functions, communications, and content provided therein.

2.8. “Account” is the means by which a user accesses the Services provided by Triptix.

Please note that these definitions are applied consistently throughout these Terms unless explicitly stated otherwise.

 

 

  1. User Obligations and Conduct

3.1. All Users of the Triptix website and App are expected to comply fully with these Terms. Any breach may result in suspension or termination of your account, at our sole discretion.

3.2. As a User, you agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete.

3.3. You agree that you will not misuse our Services. Misuse includes, but is not limited to, using the Service for any purpose that is illegal or is otherwise prohibited by these Terms.

3.4. You agree not to share your account credentials with anyone, and you’ll notify us immediately of any unauthorized use of your account. We are not responsible for any losses due to stolen or hacked passwords. We don’t have access to your current password, and for security reasons, we may only reset your password.

3.5. You agree to use our Services only for your personal, non-commercial use, and not to provide a service to others using our Services.

3.6. You agree not to “scrape” or disaggregate data from our Services (either manually or by automated means) for any commercial, marketing, or data compiling or enhancing purpose, or to copy, re-post or re-use data from our Services for any other service.

3.7. You are solely responsible for your interactions with other Triptix Users. We reserve the right, but have no obligation, to monitor disputes or discussions between you and other Users.

3.8. You agree that you will help to protect your account and the security of other Users by guarding your password. If you believe that an unauthorized person has gained access to your account, please contact us and change your password immediately.

3.9. You are responsible for all hardware, software and internet connectivity necessary to access and use our Services. If you access our Services over mobile, you are responsible for any fees that your carrier may charge for data, text messaging, and other wireless access or communications services.

3.10. You agree not to post any User Content that infringes on the intellectual property or privacy rights of others. All feedback, comments, and suggestions you provide will be treated as non-confidential and non-proprietary to you.

3.11. You acknowledge and agree that Triptix has the right to enforce these obligations and conduct guidelines at its sole discretion, and that failure to adhere to these obligations and guidelines may result in termination of your access to the Services.  In those circumstances, no refund of your subscription fee will be made.

 

  1. Registration and Account Security

4.1. As part of the registration or account creation process, Users will create or be assigned a username and password. Each User is solely responsible for maintaining the confidentiality and security of their username and password.

4.2. Users agree to notify Triptix immediately of any unauthorized use of their username, password or account. Triptix will not be responsible for any losses arising out of the unauthorized use of a User’s username, password or account.

4.3. Users may not use a username or account that is used by someone else, is vulgar or otherwise offensive, or infringes upon others’ trademark or other proprietary rights. Triptix reserves the right to reject or terminate the use of any username that it deems offensive or inappropriate.

4.4. Users are required to provide accurate and complete information when creating an account and are obliged to update this information to keep it current. If false information is provided, Triptix reserves the right to terminate the User’s account and no refund of subscription fees will be offered.

4.5. In the event of termination or suspension of your account, no refund will be granted, no online time or other credits will be credited to you or can be converted to cash or other form of reimbursement.

4.6. We strive to create a global community with consistent standards for everyone, but we also strive to respect local laws. The following provisions apply to Users outside the European Union: (a) you consent to having your personal data transferred to and processed in the United Kingdom or any other countries where we operate; and (b) if you are located in a country embargoed by the United Kingdom, or are on the U.K. Treasury Department’s list of Specially Designated Nationals you will not engage in commercial activities on Triptix (such as advertising or payments).

4.7. Triptix reserves the right to take any necessary action on user accounts to comply with legal obligations, and report to the authorities if any illegal act is discovered on the Triptix platform.

 


  1. Payment Terms

5.1. Some parts of the Triptix service are billed on a subscription basis. You will be billed in advance on a recurring, periodic basis. The billing cycle is set either on a monthly or annual basis, as determined by your arrangement with Triptix.

5.2. At the end of each billing cycle, your subscription will automatically renew under the exact same conditions as your existing subscription unless you cancel it or Triptix cancels it. You may cancel your subscription renewal either through your online account management page or by contacting Triptix customer support team.  We require five working days’ notice of cancellation; otherwise you may be billed for the next subscription period.

5.3. A valid payment method, including credit card, is required to process the payment for your subscription. You shall provide Triptix with accurate and complete billing information that includes full name, address, state, zip code, telephone number, and valid payment method information.

5.4. By submitting such payment information, you automatically authorize Triptix to charge all subscription fees incurred through your account to any such payment instruments.

5.5. Should automatic billing fail to occur for any reason, Triptix reserves the right to terminate your access to the service with immediate effect and without notice.

5.6. Unless explicitly stated otherwise, all fees, charges, and payments collected by Triptix are non-refundable. You are responsible for all charges incurred under your account, whether made by you or another person using your account.

5.7. Triptix reserves the right to change the payment terms and fees upon thirty (30) days prior written notice to you. Such notice may be provided at any time by posting the changes to the Triptix website or through the service itself.

 

  1. Privacy

6.1. At Triptix, we take your privacy very seriously. We understand that you trust us with your personal information, and we are committed to protecting the privacy and security of all data provided by users in connection with their use of our service.

6.2. Your use of the service will involve the processing of personal data, and for such processing, we are considered the data controller under the General Data Protection Regulation (GDPR), and other applicable federal, state and local privacy laws.

6.3. The type of personal data we collect and process includes, but is not limited to, your name, email address, billing address, payment details, IP address, location data, and other relevant information. We use this information to deliver our service to you, to manage your account, process payments, and communicate with you about your use of our service.

6.4. We implement a range of security measures to help protect your personal information. These measures include encryption of sensitive data, firewalls, access controls, and other necessary actions to ensure that your personal data is stored securely.

6.5. We may share your personal data with third-party service providers to perform tasks on our behalf and to assist us in providing our service. These service providers are contractually bound to protect your personal information and to use it only as necessary to provide services to us.

6.6. We will not sell, rent, or share your personal data with third parties for their marketing purposes without your explicit consent.

6.7. We may also use your personal data to comply with any applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful requests for information we receive, or as necessary to protect our rights and interests.

6.8. You have the right to access, correct, or delete your personal data. You can manage your account settings within your account, or by contacting us with your request.

6.9. We may use cookies and similar technologies to improve and personalize your experience on our service. You can control your cookies settings within your browser.

6.10. Our Privacy Policy provides more detailed information about how we use and protect your personal data. By using our service, you acknowledge that you have read and understood our Privacy Policy.

  1. Intellectual Property Rights

7.1. All of the content that appears on the Triptix website, including all visuals, text, audio and video clips are subject to copyright protections and /or other intellectual property rights or licenses held by Triptix. The entire content of the Triptix website is copyrighted as a collective work under international copyright laws.

7.2. Triptix and its logo are registered trademarks of Triptix, and they may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Triptix.

7.3. Users do not acquire any ownership rights as a result of downloading material from or uploading material to the Website. All materials posted by Triptix are protected by copyrights, trademarks and other intellectual property and proprietary rights. These materials may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, without the prior written consent of Triptix.

7.4. You agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, create derivative works from, or otherwise exploit any content or third party submissions or other proprietary rights not owned by you, (i) without the consent of the respective owners or other valid right, and (ii) in any way that violates any third party right.

7.5. Your use of the Website grants no rights to you in relation to any copyright, designs, and trademarks and all other intellectual property and material rights mentioned, displayed, or relating to the Content (defined below) on the Website. All Content, including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this Site, are protected by national intellectual property and other laws and international treaty provisions.

7.6. If you suspect that the content or trademark of Triptix is being misused, please contact us immediately. We take copyright infringement and violation of intellectual property rights very seriously and are committed to enforcing these rights within the framework of existing law.

 

  1. Limitations of Liability and Disclaimers

8.1. Triptix provides the services on an “as is” and “as available” basis. To the fullest extent permissible by law, Triptix disclaims all implied warranties, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.

8.2. While Triptix endeavours to provide the most accurate, up-to-date information available, the directories and information contained within our website may, at times, contain technical inaccuracies or typographical errors, and we do not warrant the accuracy of any posted information. Please note that such errors, inaccuracies or omissions may relate to pricing and availability, and we reserve the right to cancel or refuse any order placed based on incorrect pricing or availability information.

8.3. Triptix does not warrant that the functions contained in the service provided by the website will be uninterrupted or error-free, that defects will be corrected or that this service or the server that makes it available will be free of viruses or other harmful components.

8.4. Triptix, and its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for any loss or damage, direct or indirect, incidental, special, consequential or punitive damages, including without limitation, economic loss, loss or damage to electronic media or data, goodwill, or other intangible losses, resulting from (i) your access to or use of the service; (ii) your inability to access or use the service; (iii) any conduct or content of any third-party on or related to the service; (iiv) any content obtained from or through the service; and (v) the unauthorized access to, use of or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other claim in law, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.

8.5. Triptix will not be liable in instances where details are wrong for a match, concert or event, or if the match, concert or event changes or is cancelled, and the user has booked flights, tickets or hotels using information provided by Triptix.

8.6. Triptix will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

8.7. Triptix makes no representations that the Service is appropriate or available for use in all locations. Those who access or use the Service from other jurisdictions do so at their own volition and are entirely responsible for compliance with local law, including but not limited to export and import regulations.

8.8. These disclaimers and exclusions shall be governed by and construed in accordance with the laws of Scotland. If any provision of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

8.9. Any failure by us to enforce any of our rights under these terms and conditions shall not affect our right to enforce them at a later date or waive our rights to do so. Similarly, any breach of any of these terms and conditions by you shall not constitute a waiver of our rights relating to any other breach of the terms and conditions.

 

  1. Termination

9.1. We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Such termination will be without prejudice to any rights or claims Triptix may have against you under these terms of service.

9.2. Without limiting the foregoing, Triptix may terminate or suspend your use of the services if we believe, in our sole and absolute discretion, that you have violated or acted inconsistently with the letter or spirit of these terms of service, or violated our rights or those of another party. We also reserve the right to terminate your access to the service if your account becomes inactive for an extended period of time.

9.3. Upon termination or suspension, your right to use the services will cease immediately. You acknowledge and agree that we shall not be liable to you or any third party for any termination or suspension of your access to the services or for the removal of information related to your account.

9.4. Upon termination for any reason, all rights granted to you under these terms of service will cease; all payments owing to us shall become due and payable immediately, and we may delete or deactivate your account and all related information and files in your account, and bar access to such information or files.

9.5. Triptix will not have any liability whatsoever to you for any termination of your access to our services, including for termination of your account or deletion of your content. Sections 6 (Privacy), 7 (Intellectual Property Rights), 8 (Limitations of Liability and Disclaimers), and this Section 9 (Termination) shall survive any termination or expiration of these terms.

9.6. If you wish to terminate your account, you may do so by following the instructions on the site or through the services. Please note that while your cancellation will be effective at the end of the current billing cycle, your information may remain on our systems for a period of time.

9.7. We have the right to investigate violations of these Terms of Service and may also consult and cooperate with law enforcement authorities to prosecute users who violate the law.

9.8. If you violate these Terms of Service, we may, at our sole discretion, issue you a warning regarding the violation before we terminate your account. Whether we choose to issue a warning or not, such violation of these Terms of Service may result in our taking one or more of the following actions: (i) issuing warnings; (ii) suspending or terminating the service, your account, and/or your ability to use or access the service, with or without notice; (iii) confiscating or revoking rewards, prizes or subscriptions; or (iv) restricting, downgrading, suspending, or terminating your access to features and functions of the service.

 

  1. Governing Law and Jurisdiction

10.1. These Terms of Service, as well as any disputes arising from them, the termination of a contract or any agreements they incorporate by reference, and your use of the Services and the Triptix website are governed and interpreted under the laws of England and Wales, without regard to its conflict of law principles.

10.2. You and Triptix agree to submit to the exclusive jurisdiction of the courts of Scotland. This means that any legal matter, which will include any claim relating to your use of the Services, will be resolved by the courts of England and Wales. This agreement to the jurisdiction and venue of these courts is without prejudice to your rights under applicable law to bring proceedings against us in your country of residence under the applicable laws.

10.3. Notwithstanding the foregoing, we reserve the right to bring enforcement actions, apply for injunctive remedies (or an equivalent type of urgent legal relief) and take any necessary steps to protect our intellectual property rights in any jurisdiction where we have reasonable grounds to believe that infringement is taking place.

10.4. If you are a consumer, please note that the provisions in this section do not diminish your non-waivable statutory rights under applicable laws, to the extent that such rights apply in your own jurisdiction. For instance, if you are a consumer, you may benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms of Service, including the preceding clause, affects your rights as a consumer to rely on such mandatory provisions of local law.

10.5. These Terms of Service will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded.

10.6. Any failure by Triptix to enforce these Terms of Service or any provision thereof shall not waive our right to do so.

 

  1. Dispute Resolution

11.1. We value our relationship with you and our aim is to address your concerns swiftly and to your satisfaction. Should you have a dispute with us, we strongly encourage you to contact us directly in the first instance at contact@triptix.co.uk before resorting to more formal means of resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation, as alternatives to litigation.

11.2. Notwithstanding the foregoing, we reserve the right to bring enforcement actions, apply for injunctive remedies (or an equivalent type of urgent legal relief) and take any necessary steps to protect our intellectual property rights in any jurisdiction where we have reasonable grounds to believe that infringement is taking place.

11.3. This Section 11 will survive any termination of these Terms of Service.

 

  1. Changes to Terms

12.1. We continually strive to improve our services, and as a result, we may need to update these Terms of Service from time to time to accurately reflect our services and practices. However, we will only make changes if the reasons are valid and reasonable and we will inform you of any significant changes.

12.2. Most changes will be minor and will not affect your rights or obligations under these Terms. When making any updates, we will consider your interests and rights. For instance, if we were to add a new service that requires a new form of user data, we would explain how we would use this data and provide you with options for consent.

12.3. We will notify you of any significant changes to the Terms of Service by sending an email to the email address associated with your account, or by placing a prominent notice on our site. For minor updates that do not affect your rights, obligations, or privacy, we will update the “Last Updated” date at the top of these Terms.

12.4. We encourage you to review the Terms of Service regularly to stay informed of any updates. Your continued use of the Triptix services after the effective date of the updated Terms means that you accept the new Terms. If you do not agree to the updated Terms, you must stop using our services and close your account.

12.5. If you continue to use our services after the date on which the changes come into effect, your use of the services indicates your agreement to be bound by the new Terms of Service.

12.6. In case of disagreement with the proposed modifications, you should notify us before the date of their entry into force, failing which you will be deemed to have accepted them.

12.7. This Section 12 will survive any termination of these Terms of Service.

13.5. In the event you have any complaint or dispute, you agree to contact us directly first and give us the opportunity to resolve the issue before resorting to other means.
